Those changes have been tough...but are beginning to pay off.

Mercy Health VNS does not supply personal information, including your home. address, cell phone or email to anyone until we are ordered to do so by a Court or government agency, like the NLRB.

However, since the union asked for an election, we were required to provide that information to the union today.

Mercy does not send people to your home for any reason. IF someone visits your home pretending to be from Mercy, they are not telling you the truth.
A good safety practice is to ask anyone who comes to your door to show you ID and business card, and confirm they are who they say they are with their employer before letting them into your home.

If they are in fact from the union they have no more rights than any other door‐to‐door salesman, and you do not have to speak to them. Whether you do or not is entirely your choice.

You do not have to answer the phone or text messages. It’s up to you.

You do not have to tell ANYONE if you are voting, or how you are voting.

If you feel threatened or harassed you can send a “No Solicitation” form to the union, and/or report it to the NLRB or the authorities.

The average time to negotiate a first contract is 18 months, and there is no legal requirement on when an agreement must reached.

The time it takes the SEIU to bargain a contract varies greatly but takes a long time. SEIU’s current bargaining in several local hospitals has taken more than 12 months without reaching a renegotiated agreement for nurses.

One local union of about 200 members split with an almost unanimous vote, claiming SEIU Healthcare Michigan was spending little on bargaining while blowing money on parties and a brand-new SUV for (union President) Faville. Members also said the union was paying for her apartment…
Union members who worked at hospitals were increasingly upset about the union’s scheme to “fake represent” home caregivers, most of whom did not know they were unionized or received any benefits from the union…
The election fight got nasty with allegations of people losing their jobs for opposing Faville. Three different ballots were sent out, and one Middle Eastern union member compared the SEIU Healthcare Michigan election to Bashar Assad getting "elected" again and again in Syria. Ultimately, Faville prevailed and still heads the union today…”

FREQUENTLY ASKED QUESTIONS
1. Why can’t Mercy tell us what they would do if the SEIU doesn’t get in?
Because the law prevents a “party capable of carrying out a promise” from making a promise. Look at the Notice of Election – there is a section that addresses that, and your care manager can show you. Mercy IS capable of carrying out a promise. If the union is promising things, aren’t they just admitting they are NOT capable of carrying out that promise?
The best we can do right now is to ask you to work directly with us and give us an chance to work directly with you. In a year, if you still think you need a union, you can get one then, and if so, you might find a union that has fewer problems or a better balance sheet.
2. Is there any guarantee the union will ever have a contract?
No. In fact, unions complain that they fail to get first contracts about half the time, and that when they do, they say it takes too long. That’s a valid complaint but “the law does not require either party to agree to a proposal or require the making of a concession…” [NLRB, Basic Guide, page 24].
Both parties have to bargain in good faith but even when they do agree, you may find what is in the proposal isn’t what you wanted, or it addresses someone else’s issue at your expense. You just don’t know.
Since the union would be your exclusive agent, you couldn’t cut a “side agreement” on your own. Remember, only dues paying members in good standing are allowed to vote on contracts, or strikes.
3. A lot of people were angry at all the changes and feeling they weren’t being listened to, why should they give Mercy a chance?
Well, that’s the question we hear the most.
The fact is, Mercy doesn’t want a chance, Karen and the people who are responsible for the success and well being of the agency and the patients want a chance. And that includes all of us: The office based care managers, the educator and schedulers the quality team, the home care coordinators, the therapy staff, the leaders and the nurses themselves.
What Karen wants is a chance for all of us to work together to give us ALL a chance to show we don’t need a third party here between us.
Some staff – therapists for example – have had issues addressed because we can work directly with them. Other problems we have tried to address (like scheduling late visits because of late discharges from the hospital) through your leaders. We believe these things are best and most quickly addressed by working directly together.

"IT IS ORDERED that the Petitioner's request to withdraw its petition is approved, with prejudice. Any petition filed by SEIU Healthcare Michigan, Service Employees International Union, CTW within six months from this date that encompasses the same or substantially the same unit of employees as involved in this matter will not be entertained unless good cause is shown.
IT IS FURTHER ORDERED that the election scheduled for October 24, 2017 is cancelled. Inasmuch, the Employer should post this order next to all Notices of Election that were previously posted.
